Hi All,
My employer after too much of talks is ready to file. But in all the applications he wants to put his address so that he receives the EAD card and AP..He is not ready to put my address. Can he keep my EAD card ?

Hello!
I was laid off from Company A on H-1B in May 09. My EB2, India, I-140 was approved in Mar 09. Since PD is not current, I-485 has not been filed yet. Here are my questions:
Can I retain my PD if Company A withdraws(worst case) my I-140 petition?
If I find employment with Company B, can I still file my I-485 using Company A's I-140 petition assuming Company A provides me with an Employment Letter for future employment?
If previous step is feasible and I-485 is approved within 180days of filing, will it pose any issues if I have to invoke AC21? (since I will be working for Company B when I file I-485 with Company A) I ask this because I have 2 yrs and 4months on my H-1B off the 6yr limit and I am afraid I might run out of H-1B time before I file I-485.

Your obligations to IRS does not interfere with your GC process. This is not a "work" that you are getting paid for, outside your LCA.

Hi Friends,
My EAD expires in the mid of August.I am planning to go india at last week of July.I thought of applying for EAD renewal now.But my lawer said it is always preferrable that the candidate must present in US while processing EAD renewal.Is it ok if I apply for renewal after I come back from India.By that time,My EAD already expires.Will it be a problem If I apply for renewal after expiry of current EAD.I am currently on H1B visa and I am not using EAD status now.If it is a problem,I will postpone my India trip.

Hello,
I applied AOS in July 07 and was waiting for my and spouse FP till now. Last week I received FP notice for my spouse but her middle name on FP notice is spelled wrong. But her I-485 receipts and EAD are spelled correctly. What do I do ? Do I need to contact them and have it corrected before she appears for the FP appointment. Her FP appointment is next week so there is not much time left. I was thinking , that when she appears for FP appointment to let them know about the spelling mistake.

My I 485 package was returned as it didnt have the approval notice of I 140, which was submitted a day later than I485 by my company.
It is such a frustrating situation as i have been waiting since 1999 for my GC , and when i got this golden chance my company was not serious enuf to submit the papers in time !
I am doubting the company , as they would have done all this intentionally to keep me in their co. for longer time!The returned letter they have provided me shows no reference no, file no, or either my name ! how can i believe if they have even submitted any papers for I485 or not ?
They say they can refile again .. but duno what to do ??
Can anybody be kind enough to help me out here!

Can someone please tell me on how to reach the customer service personal? What are the options to press after 1-800-375-5283.
I received a Biometric Apt. through my attorney a month back and I appeared for the apt. The time was coincided with my move so it went to attorney and didnt come to my address.
Now I received another notice dated one month later than the first one. So I want to talk to them and findout if it necessary to appear again.

my wife went to mumbai embassy. after intw they said they need some more info in their systems before issuing the visa. It was h1 renewing. But they didn't keep the passport. Told to submit the passport after they sent email or call you. They did sent the email to submit the passport within 2 days.

I transfer my H1B to company B and works for company B. Now suppose if I want to go back to company A after six months and want to work for company A, does the h1b transfer required? (means, does company A requires to file whole h1b petition again?) Here my petition (I-797) with company A is still valid. And suppose if I want to go back to company A after 4 years, at that time my petition (I-797) with company A might be expired, does the company A requires to file new petition (tranfer) or just the extension?

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

Is there any one in this situation?
1. Date is current(because of interfile) and received 2 year EAD
2. USCIS District Office IO cannot find whether the case is EB2 or EB3. Is it true or there any experiences?
3. Does any one know of any pattern of how long it will take to approve the case once its assigned to an Office?
