My wife's EAD expires 10/10/08, she is currently on H4 but we filed last july and got our EAD/AP. I am planning to send her to india in May and she'll be back in November around 4th (AP expires Nov 19th).
Please help me with info on these questions?
1. Does she have to be in USA to apply for EAD renewal?
2. Can she apply for EAD renewal in May (5 months in advance), I know AP cant be applied before 4 months but dont know about this EAD.
3. Or Can EAD be applied after it expires also, if yes till howlong after it expires?
4. Also she'll come back on 4th Nov and applies for AP immediately, is this OK if she applies before expiry date of Nov 19th but doesn't get the approval? (I know that she cant travel until she has a visa in passport or AP again)

I took the citizenship test, biometic now the second time .passed it 2 1/2 years ago . I was told the immigration did not have my filed . So Wait. Went to immirgation office 3 times. no result . Case under review ????? what is that mean????? Am confused ... No one can tell me what was going on . I have done no wrong. pay my taxes....

Hey there,
I have currently applied for H1B visa under Masters Quota (Regular Processing). And its still under process but I want to know if by any chance I get rejected this year, how much are the chances of being approved when I apply next year. Will it make a negative impact when I apply next year? I am currently on OPT and my course is under STEM. Also let me know if there are any other options.

Guys, we should have more rallies like the SJ one in bay area.. the next target can be San Francisco - Civic Center.
There are many official bulidings like City Hall here and we will definitely get heard again.
I always suggested for this type of gathering on roads so as to get heard. THIS WAS A JOB WELL DONE by people who attended and organized.
Finally to gsc and others, save banners and material from the the SJ rally so that we dont have to start from scrach.
For the people who didnt make it, please attend the next one no matter what.

Current EAD was supposed to expire in Feb so applied 100 days ahead for renewal. To my surprise application got approved in 10 days:D. Hope they've given for 2 years and starting from expiry date of current one....

WASHINGTON -- The Democratic-controlled Congress and President Bush seem locked in a perverse competition for public unfavorability, according to a new Associated Press-Ipsos poll.
The survey shows Bush's approval ratings at 35 percent, and Congress' even lower, 25 percent. Only 27 percent of those polled said the country is headed in the right direction, and 39 percent said they support the Iraq war, with 58 percent opposed.
While Bush's favorability ratings have remained relatively unchanged for months, Congress' support declined markedly between May and July, a dip confirmed in a poll of 1,003 people taken last week.
Asked whether they approve or disapprove of the way Congress is handling its job after seven months of divided government, those surveyed were then prompted to volunteer a reason.
Of the 74 percent of those expressing congressional disapproval, 22 percent said lawmakers generally aren't doing their jobs. Another 20 percent cited a specific issue for their unhappiness. Twelve percent said they disapprove of Congress because lawmakers care only about themselves and their party, while 10 percent cited backstabbing and infighting.
Among those who cited an issue, the war in Iraq was mentioned most often. It was cited by 7 percent of those disapproving of Congress' performance, followed by health care, 5 percent; immigration, 2 percent and employment and wage issues, 2 percent.
The survey was taken as Congress was beginning its August recess, providing a respite from months of unsuccessfully trying to force Bush to change course in Iraq.
Democratic leaders have vowed to renew their challenge to Bush when they return to the Capitol after Labor Day. An autumn clash also looms over federal spending, and Bush has posted veto threats against bills dealing with farm programs, expansion of children's health care and energy.
"I don't think this war is going the way it should be. We're over there for nothing," said Richard Reda, 64, of Nashua, N.H., a Vietenam War veteran and self-described political independent.
In an interview, he said, "I think Congress should go over Bush's head and get these troops back here. There's got to be a way where they can override Bush to get the troops back here."
Maria Guyan, a 28-year-old school secretary from Struthers, Ohio, agreed. Guyan described her politics as "lean Democrat" and said, "I just don't think they're doing enough to keep President Bush from basically going forward on whatever he wants."
She said Congress should focus most on withdrawing from Iraq and improving the nation's education system.
"We definitely need to get out of the war, and we need to basically just realize we cannot run another country in addition to our own," she said.
But Peggy Grandinetti, 69, a Republican from Florence, Ala., criticized Congress for not standing by Bush on the war.
"I just completely disagree of pulling out of Iraq. I think we ought to stay there and finish the job," said the retired medical assistant.
Richard Henson, 58, of Atlanta, Ga., was among the Democrats who said Congress has failed to address a problem with illegal immigration.
"The immigrants are running bills up," said the post office manager, citing health care and school taxes as examples. "We have to pay extra taxes to support illegal immigrants. I don't think they should benefit from our services that we're paying taxes on."
Wes Kangas, 65, a Republican and retired banker in Vancouver, Wash., expressed weariness. "They don't seem to get anything done. All they do is bicker back and forth. After a while it gets kind of old," he said.
Republicans were more likely to say Congress wasn't doing its job, 26 percent, while Democrats tended to cite a specific issue, 24 percent. Among independents, 22 percent said generally that lawmakers weren't doing their job, and 20 percent pointed to a specific issue, a list topped by the war in Iraq.

No, this should not cancel H4.. But using EAD for work will do...
You can use EAD to get SSN, DL...
H4 status and AOS pending are not mutually exclusive. Meaning one can have AOS pending and still be on H4. Applying for SSN on the basis of EAD doesn't invalidate one's H4 status.

I'm Australian and would like to return to the U.S. to visit in-laws with my partner but I overstayed my visa on my last visit.
On my last visit, I received a 6-month visitor visa then extended my visa another 6 months. I overstayed my visa by 11 weeks; I was helping my same-sex partner move. This was two years ago. I did not work for anyone while in the States.
What can I do if any to improve my chances of not getting turned away at Immigration?

I wanted your advice. I filed for my 485. Then hit retro. Got married. Now got current in June VB. Want to apply wifes 485. EB2 India PD 15 March 04. Initially lawyer said he would do everything in one fees. Now he says he will charge 1000 dollars more since he is filing for wifes separately. I was wondering whether to do it myself. Is it advisable? Has anyone done it succesfully? If so what do you put on top of your application so that USCIS knows I am filing for derivative and my PD is current and so they wont reject the docs? Thanks.

I am on H1 (primary), currently working for this company for past 6-7 years. Applied for I-485, AP, EAD on 2nd July along with my husband's petition, who came to US on H4. Changed to F1 for past 5 years. He just got his EAD card and in next 6 months time, he will be accepting position with my same company upon graduation.
My question is what shd we do now, since he is on F1 on student records, but has a EAD approved.

I came to US on F1 student visa for Masters. After completion i had my OPT(from sep/1/2007 to sep/2/2008). My employer applied for H1 in april/08 and i got approved. So currently my status is H1 starting from Oct/1/2008.
Iam a consultant (Oracle PL/SQL developer) & i was on the project for a few months(from june/08 to august/08). Since august, iam on bench period and not getting paid by my employer & currently looking for a project!!!
My questions are;
1) How long can i stay like this on the H1 visa without getting paid or untill i get into a project; even though iam employed by the company and, are there any restrictions?
2) Will it cause any problem in future?
3) Also i have to go for the H1 stamping; any guidelines on tht?

I got really good news... EB3 moved for 1 week...... its 22nd Jan 2002 now...:rolleyes:
Based on the numbers released by USCIS on pending 485s, EB3 will go up to mid-june 2002 for the entire FY2011 (without spill over, of course)....
