I have another dumb question.
If you apply for COS from US for conversion from H4 to F1 and if the course study falls under TAL then will the COS procedure will take more than normal time? Have anyone experienced this before?

My wife has a valid H4 visa and she's currently in India as her company is applying for a fresh H1B visa for her. I'm currently in US on valid H1B visa till 7-Dec-2011.(Her H4 will also expire on the same date)
Qs: After getting the recipt for H1B application, can she travel on her H4 visa or does she have to wait till the approval\rejection of H1B?
Please note that this is not a case of H4 to H1 transfer.

I got my EAD approved from NSC on 25th. I see a message-- card ordered. Today there is one LUD , approval notice sent.

Kudos to my colleague Elissa Taub who pointed out something rather interesting that none of the supporters of the Arizona law have told Arizonans. Under federal immigration law, a removal proceeding is a civil proceeding and one is not entitled to a public defender or any assistance in paying for help from an immigration lawyer. However, the new Arizona law makes it a state crime to be illegally present in the state. What this means is that any person charged under the new law is entitled to a taxpayer funded public defender or taxpayer funded private lawyer. And we lawyers...

Hello friends -
My Receipt notice states that RECEIVED DATE for my 485 is July 17, 2007 and the NOTICE DATE is September 14, 2007.
In my USCIS online account when my click on my 485 RECEIPT No. it states -"CASE recd. & pending" ...On September 14, 2007, we received this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, and mailed you a notice......
Shouldn't this state that they recd. the case on July 17, 2007.?? Can it be true that their system is showing a recd. date of 9/14 when actually the recd. date on the actual notice/797 is 7/17/07.
How many folks are seeing this.?? Is this how it is supposed to be..I mean is it normal for them to generate a default message like this using the NOTICE DATE when you click ur case #..??

My priority date is Jan 2006 in EB3 and I wanted to understand what happens after you file I-485. Is is all first come first after that or they will process 485based on priority date. What if I filed my 485 on july 1 and another person with an earlier priority date filed it after 6 months considering the priority dates are still current till then. Will mine be processed before the other guy.
Also, I was going to take a promotion in my company and file a new application in EB2 but with all dates being current now I am confused. I will still apply for 485 in Eb3 and get the benefits for EAD and AP but I am sure the final approval and getting of green card is going to take 5-6 years for jan 2006 eb3 dates.
My questions
Can I still change to Eb2 after filing a 485 in EB3?
Can I port the priority date from EB3 to Eb2 after eb3 140 is approved?
Please help

Hi All,
I would like to apply my 9th year H1B transfer with new employer based on my Labor which is pending for more than 365 days with my Current Employer. The proofs which I got from my current Employer are
1. Certified mail receipts showing the date my documents were received by the Labor Department.
2. Fax received on year 2004 from Labor Department which shows list of employees for whom they filed labor via my current company. This contains my name, case number and priority date.
3. Based on this pending Labor I got last year extension with my current employer.
4. Labor documents which they sent DOL.
Would this information be sufficient and helpful to file H1B transfer for me? Or Do you need any other information to do H1B Transfer? If so please let me know In which ways I can get the information other than my Employer. My employer will not cooperate with me in this issue.

WASHINGTON (Reuters) - President George W. Bush wants it known the U.S. Congress has been asleep at the switch since Democrats took over in January. The only problem is that he and his fellow Republicans have flipped off the switch at nearly every turn, Democrats say.
"The end of 2007 is approaching fast and the new Congress has little to show for it," Bush told reporters in the White House Rose Garden last week.
Rep. John Boehner of Ohio, the Republican leader in the House of Representatives, was even less generous. "Nothing has been accomplished all year," he said.
As they excoriate political opponents, Bush and his fellow Republicans in Congress have successfully stopped most major Democratic initiatives this year.
They have staged an unprecedented number of "filibusters" in the Senate, where Democrats do not have a big enough majority to end debate. The few times that wasn't the case, Bush used his veto pen to kill Democrats' top priorities, like ending the Iraq war, expanding health care to children from low-income families and expanding stem cell research.
"Sadly, Republicans in Washington are determined to make this a 'no-can-do' Congress," Assistant Senate Majority Leader Richard Durbin, an Illinois Democrat, said in his party's weekly radio address on Saturday.
With only a week or two remaining in the first half of 110th Congress that convened in January, there's a deflated feeling on Capitol Hill.
Democrats and Republicans complain not enough has been accomplished. The public seems to agree, with just one in five Americans approving of the job Congress is doing, even worse than the unpopular Bush's ratings.
The legislative deadlock might get even worse next year, as election campaigns for Congress and the presidency get into full swing.
Ethan Siegal of the Washington Exchange, a private group that tracks Congress, said of Republicans' opposition tactics: "The template for trying to get into power is to make sure the party in charge doesn't have many legislative successes."
But even many Republicans think accusations of a "do-nothing" Democratic Congress won't be enough for their party to win back their majority status in the November 2008 elections.
PROMISES KEPT?
Democrats quickly fulfilled many of their 2006 campaign promises, raising the minimum wage for the first time in a decade, implementing stalled recommendations of the commission that investigated the September 11 attacks and trying to stop ethics abuses that plagued Congress during years of Republican leadership.
Republicans blocked many other measures.
A top domestic priority -- reforming U.S. immigration law -- was buried by conservative Republicans in the House. On foreign affairs, Republicans killed repeated moves to bring combat in Iraq to an end, despite Americans' disenchantment with a war now in its fifth year. Anti-war feeling was a driving factor behind the Democrats' success in last year's elections.
Popular legislation to expand stem cell research to help cure diseases such as Parkinson's was vetoed by Bush, as was a bill to deliver health care to more children from low-income families.
More recently, the House passed an energy bill that would improve automobile fuel efficiency for the first time in 32 years but Senate Republicans, heeding a White House veto threat, stopped it.
And Bush has veto threats on the remaining bills to fund the government through next September.
He recently told Arkansas business leaders: "You're fixing to see what they call a fiscal showdown in Washington."
But despite the bluster, Bush and congressional Democrats are at odds over a relatively tiny slice, about $11 billion, of the nearly $3 trillion budget.
Negotiations between the two finally have begun, but a compromise -- some war funding coupled with some of the additional domestic spending Democrats want -- was showing signs of souring this week, again amid accusations of Republican sabotage. There's plenty of incentive for a deal though as neither side wants government shutdowns to begin if agencies run out of money this month.

My I-140 approved in Aug 2007,My employer has withdrawn the I-140 in july but still it is approved in Aug 2007,Now my employer is agreed and want to sent the letter to USCIS not to withdrawn this I-140,As I am in Canada so they are planning to file the I-824 for me for Consular processing,so please advice do they need to file the new I-140 for me for Consular processing as they sent the withdrawn letter to uscis or is it ok for them to sent the letter again to uscis and telling them not to withdrawn this case and file I-824 for CP.Please advice!!!!!!
